Temporary and Deferred Surrender

 

1. If the extradition is granted in the case of a person who has been prosecuted or is serving a sentence in the Requested Party for an offence committed other than that for which extradition is requested, the Requested Party may temporarily surrender the person sought to the Requesting Party for the purpose of criminal prosecution. The person so surrendered shall be kept in custody in the Requesting Party and shall be returned to the Requested Party after the conclusion of the proceedings against that person in accordance with conditions to be determined by mutual agreement of the Parties.

2. The Requested Party may postpone the extradition proceedings against a person who is serving a sentence in that Party for an offence other than that for which extradition is requested or who has been criminally prosecuted in that Party. The postponement may continue until the prosecution of the person sought has been concluded or until such person has served any sentence imposed.
