Article 35
Damages
1. When legal action on liability for damages resulting from an act or omission in relation to cooperation under this chapter has been initiated by a person, the Parties shall consider consulting each other, where appropriate, to determine how to apportion any sum of damages due.
2. A Party which has become subject of a litigation for damages shall endeavour to inform the other Party of such litigation if that Party might have an interest in the case.
